Understanding Family-Based Immigration

Eligibility Criteria for Family Visas

Family-based immigration is a popular way for individuals to obtain permanent residency in the United States, often referred to as a green card. To be eligible for a family-based visa or green card, one must have a qualifying relationship with a U.S. citizen or lawful permanent resident (green card holder).

Eligible relationships include:

  • Immediate relatives of U.S. citizens: Spouses, unmarried children under 21, and parents.
  • Family preference categories: Unmarried sons and daughters over 21, married children of any age, and siblings of U.S. citizens; as well as spouses, minor children, and unmarried children over 21 of green card holders.

Family Preference Categories

Family visas are divided into categories under the family preference system, each with its own waiting list. The preference categories are as follows:

  1. F1: Unmarried sons and daughters (over 21) of U.S. citizens
  2. F2A: Spouses and minor children (under 21) of green card holders
  3. F2B: Unmarried sons and daughters (over 21) of green card holders
  4. F3: Married sons and daughters of U.S. citizens
  5. F4: Brothers and sisters of U.S. citizens

Adjustment of Status vs. Consular Processing

Once the U.S. Citizenship and Immigration Services (USCIS) approves the Form I-130 (Petition for Alien Relative), the beneficiary can apply for a green card through either Adjustment of Status or Consular Processing.

Adjustment of Status: This process involves filing Form I-485 (Application to Register Permanent Residence or Adjust Status) while the beneficiary is in the United States. Applicants must submit supporting documentation, such as an Affidavit of Support, to prove they meet the eligibility criteria.

Consular Processing: In this method, the National Visa Center (NVC) processes the application and sends it to the appropriate U.S. consulate abroad. Beneficiaries must then attend an interview at the consulate and, if approved, will receive an immigrant visa to enter the United States and become permanent residents.

It’s important to note that waiting times for family preference visa categories can be lengthy, and depend on the priority date, which is determined by the date when the Form I-130 was filed with USCIS. Immediate relatives of U.S. citizens, however, have no waiting time and can apply for their green card as soon as their petitioner’s I-130 is approved.
